Terms And Conditions

Qadaya Misr

Welcome to Qadaya Misr, a digital legal platform available through the following website: https://www.qadayamisr.com.

Qadaya Misr is a digital platform owned by Shubeik for Services and Consultancy. Its purpose is to facilitate access to legal knowledge and information, a lawyer directory, and legal consultations and services available through the platform.

These Terms and Conditions govern the use of the website, its services, and its digital features, and define the rights and obligations of users and the platform's administration.

By accessing the website, creating an account, or requesting any available service, you acknowledge that you have read and agree to comply with these Terms, to the extent permitted by law. If you do not agree to these Terms, please discontinue using services that require your acceptance.

These Terms should be read together with the Privacy Policy, Information Security Policy, and Compliance and Prohibited Requests Policy published on the website, as applicable to the service being used.

Clause 1: Definitions

For the purposes of these Terms, the following words and expressions shall have the meanings set out below:

Platform: The Qadaya Misr website, including all its pages, services, and digital features.

Owning Company: Shubeik for Services and Consultancy, the company that owns the platform and is responsible for its administration, operation, and technical development in accordance with the nature of its activities and its legal obligations.

Administration: The individuals authorized by the Owning Company to manage the platform, review and approve content, and operate its services.

User: Any natural or legal person who visits the website, uses any of its services, or communicates with the platform.

Lawyer or Specialist: A person who is qualified or licensed, as applicable, to provide a professional service within their area of expertise and in accordance with the rules governing that profession.

Services: General legal information, the lawyer directory, consultation requests, communication and booking services, and any other features made available by the platform from time to time.

Clause 2: Nature of the Platform and Scope of Services

Qadaya Misr operates as a digital platform designed to organize access to legal information and knowledge and facilitate users' access to lawyers, specialists, and available services.

Depending on the features enabled on the platform, its services may include:

  1. Providing general legal information and educational materials.
  2. Displaying legal content prepared, reviewed, and approved by the Administration.
  3. Providing a directory of lawyers and specialists and their published professional information.
  4. Facilitating consultation requests and communication with lawyers and specialists.
  5. Providing digital tools and services related to legal knowledge.
  6. Offering additional services announced by the platform, subject to their applicable terms.

Qadaya Misr is an independent digital platform. It is not a government entity and does not represent any ministry, authority, or official institution. Its existence or services must not be interpreted as government approval or official authorization unless supported by valid official documentation.

Clause 3: Legal Information and Consultations

The information and materials published on Qadaya Misr are intended for general legal awareness and informational purposes. They do not, by themselves, constitute legal advice tailored to an individual case, nor do they replace consultation with a qualified lawyer where necessary.

Legal outcomes and procedures may vary depending on the facts of each case, the available documents, the applicable law, and relevant judicial decisions.

The platform does not guarantee any particular outcome in any case or dispute, the acceptance of a claim by a court or official authority, or the issuance of a judgment or decision in the user's favor.

When a user requests a consultation from a lawyer or specialist, the nature of the professional relationship and the associated responsibilities are determined by the service provided, the applicable agreement, and the professional rules governing that service.

The appearance of a lawyer in the directory or the availability of a means of contacting that lawyer does not guarantee the outcome of their services or replace the user's responsibility to verify their professional details and suitability for the relevant matter.

Clause 4: Intellectual Property and Exclusive Rights

Intellectual property rights relating to Qadaya Misr are governed by the laws in force in the Arab Republic of Egypt and any applicable international agreements.

Assets owned by, or licensed to, the Owning Company, as applicable, may include:

  • The Qadaya Misr name, logos, trademarks, and visual identity.
  • Source code, system architecture, and databases that qualify for legal protection.
  • Graphic interfaces and user experience designs.
  • Website structure, page organization, and digital operating features.
  • Texts, articles, and educational materials prepared by the platform or for which it holds exploitation rights.
  • Images, illustrations, and digital assets owned by the platform or used under a valid license.
  • Technical documentation, designs, and unpublished internal materials.

This does not mean that the platform claims exclusive ownership of legislation, official statutory texts, or official judicial judgments themselves. The rights applicable to each item are determined by law, its source, and its nature.

Prohibited Uses

Without prior written permission from the rights holder or a lawful basis permitting such use, the following are prohibited:

  1. Copying, redistributing, or exploiting the platform's protected source code, designs, or digital assets.
  2. Reproducing its visual identity or imitating its trademarks or logos in a manner that falsely suggests an affiliation or endorsement.
  3. Extracting substantial portions of databases or commercially reusing them without authorization.
  4. Republishing protected content or commercially exploiting it beyond the scope permitted by law.
  5. Selling, licensing, or distributing any protected part of the platform without the rights holder's consent.

The following activities are also strictly prohibited unless prior written authorization has been issued by an authorized party:

  • Attempting to breach the platform's systems, scan for vulnerabilities, or conduct penetration testing.
  • Using automated tools, bots, or scraping software to extract data from the website or collect it automatically without authorization.
  • Attempting to reverse engineer, decompile, or bypass software, security mechanisms, or technical restrictions.
  • Imitating protected features, designs, or technical components to create a competing system using materials or rights owned by another party.
  • Accessing, copying, or extracting source code, internal files, or databases without authorization.

Nothing in this clause prohibits uses permitted by law or the exercise of rights that cannot lawfully be excluded by contract.

The Company may take available legal action to protect its rights and seek compensation for proven damages where the applicable legal requirements are met.

Clause 5: Information Security and Cybersecurity

The Owning Company undertakes to implement appropriate technical and organizational measures to protect the platform and the data processed through it, taking into account the nature of the services, potential risks, and applicable legal obligations.

Depending on the platform's technical infrastructure, the measures used may include:

  • Controlling access permissions for systems and data.
  • Protecting administrative accounts and sensitive accounts.
  • Applying security updates and addressing known vulnerabilities.
  • Monitoring technical activities and logs required for security purposes.
  • Taking appropriate measures to protect databases and files.
  • Creating backups and restoring data in accordance with approved operational procedures, where available.
  • Handling security incidents in accordance with appropriate procedures and legal requirements.

These Terms do not guarantee that the platform is entirely free of vulnerabilities or that data loss is impossible. No internet-connected system can be guaranteed to be absolutely secure.

User Responsibilities for Account Security

Users must:

  1. Keep passwords and login credentials confidential.
  2. Avoid sharing login details with unauthorized individuals.
  3. Use strong passwords and take appropriate precautions to secure their devices and accounts.
  4. Notify the platform's Administration promptly if they suspect an account has been compromised or used without authorization.
  5. Refrain from exceeding their permissions or attempting to access other users' accounts or data.
  6. Refrain from uploading malicious files or using tools intended to disrupt the website or damage its systems.

Users are responsible for activities carried out through their accounts to the extent legally attributable to them. Having an account does not exempt a user from liability for unlawful activity committed by them or with their participation.

Clause 6: Published Content and Content Management

Qadaya Misr's Administration is responsible for preparing, reviewing, and approving content published on the website. Users are not permitted to publish articles, cases, or general materials directly unless the platform expressly announces a feature designed for that purpose.

The Administration organizes the content in accordance with the platform's nature and objectives. It may correct, update, or withdraw published material when necessary, subject to applicable legal rights and obligations.

The platform exercises appropriate care when preparing and reviewing legal information. However, it does not guarantee that every item of content is free from errors, complete, or continuously applicable to every situation, particularly when legislation, procedures, or judicial decisions change.

Users may contact the Administration to report an error, request a review of information, or identify a more recent official source. The Administration will assess the report and take appropriate action based on the nature of the content.

Clause 7: User Obligations and Acceptable Use

Users must use the platform lawfully and in a manner that does not infringe upon the rights of others, compromise system security, or disrupt service continuity.

The following uses are prohibited:

  • Committing, inciting, or facilitating a criminal offense.
  • Circumventing the law, misleading competent authorities, or obstructing justice.
  • Forging documents, fabricating data, or knowingly providing materially false information.
  • Threatening, blackmailing, defaming, or violating the privacy of others.
  • Impersonating a lawyer, specialist, or government authority.
  • Gaining unauthorized access to systems, accounts, or databases.
  • Automatically extracting data in violation of these Terms or disrupting services.
  • Using the platform for advertising or activities prohibited under the published Compliance Policy.
  • Violating Egyptian laws, the Terms of Use, or the platform's policies.

These provisions do not prohibit users from seeking legitimate legal assistance or learning about rights, procedures, appeals, and defense options permitted by law.

Clause 8: Consultation and Service Requests

Users must provide accurate information to the extent necessary to process their requests and must not use forged or misleading data or documents.

When requesting contact with a lawyer or specialist, users acknowledge that the information necessary to fulfill their request may be shared with the selected service provider, within the scope of the request and subject to an appropriate legal basis.

Users must not submit data or documents relating to other individuals without a legitimate basis and should refrain from providing information that is not necessary to process the request.

The platform reserves the right to reject a request, request additional information, or suspend processing where there are serious indications that the request is unlawful or violates these Terms, subject to applicable law and users' legal rights.

Acceptance of a request or referral to a lawyer does not mean that the platform endorses the facts stated in the request or guarantees the accuracy of all information provided by the user.

Clause 9: Fees and Payments

If the platform provides paid services, the applicable fees and the terms governing payment, cancellation, and refunds will be specified on the relevant service page or before confirmation of the request, depending on the nature of the service.

Users are responsible for reviewing the applicable fees and service terms before completing payment.

Transactions processed through external payment providers may also be subject to their relevant terms and policies, without prejudice to users' rights and applicable legal obligations.

Nothing in these Terms shall be interpreted as waiving any consumer right or exempting the Company from a mandatory legal obligation.

Clause 10: External Links and Third-Party Services

The website may contain links, tools, or services provided by third parties, such as messaging, payment, mapping, or official website services.

The use of such services is governed by the terms and policies of the relevant providers. Qadaya Misr does not necessarily control all practices, content, or service availability of these third parties.

The inclusion of an external link does not constitute an endorsement of the provider, a guarantee of its services, or a guarantee of the accuracy of all information available through it.

Clause 11: Privacy and Data Protection

Personal data processed through the platform is subject to the Privacy Policy published on the website. That Policy explains the types of data that may be collected, the purposes of processing and sharing it, retention periods, and data subjects' rights.

Users must provide only the data necessary for the relevant service and should not submit personal information or confidential documents when there is no legitimate need to do so.

Data is processed in accordance with applicable Egyptian legislation, including relevant personal data protection and information security requirements, depending on the nature of the processing and the services provided.

Clause 12: Service Availability and Modifications

The Company seeks to operate the platform appropriately and develop its features. However, it does not guarantee uninterrupted website availability or that the website will always be free of technical failures or errors.

Certain services may be temporarily unavailable for maintenance, updates, technical troubleshooting, security measures, or circumstances beyond the Company's reasonable control.

The Administration reserves the right to develop, modify, suspend, or discontinue services or specific features when required for operational, security, or legal reasons, subject to applicable legal obligations toward users.

Clause 13: Account Suspension and Service Restrictions

The Company may suspend an account, restrict access to a service, or reject a request where reasonable grounds exist concerning a violation of these Terms, misuse, threats to the platform's security, or unlawful activity.

Appropriate measures may be taken to protect systems, users, and legal rights in proportion to the nature and severity of the violation, without prejudice to procedures or rights established by law.

Suspension or closure of an account does not prevent the Company from retaining data or records that must be retained by law or that may lawfully be necessary to resolve an existing dispute.

Clause 14: Cooperation with Competent Authorities and Legal Compliance

Qadaya Misr operates in accordance with the legislation in force in the Arab Republic of Egypt and respects the rule of law and applicable security and legal requirements.

Where the law or a lawful order issued by a competent authority requires the disclosure of data, records, or information, the Company will take the necessary steps to respond within the scope of its legal obligations.

The platform is not a government entity and does not represent any official authority. It does not claim government approval or official security accreditation unless supported by valid official documentation.

Requests and services submitted through the platform are also subject to the Compliance and Prohibited Requests Policy published on the website.

Clause 15: Limitation of Liability

The platform provides general legal information and digital services according to their nature and available capabilities. It does not guarantee any particular judicial or professional outcome or uninterrupted service availability.

To the extent permitted by law, the Company is not responsible for decisions made by users based on general information without obtaining appropriate professional advice tailored to their circumstances.

The responsibilities of the Company, lawyers, and other service providers are determined according to each party's role, the nature of the service, and the applicable legal and contractual obligations.

Nothing in these Terms excludes any liability or right that cannot be excluded or waived under Egyptian law.

Clause 16: Compensation for Damages

If a user intentionally, or through fault legally attributable to them, causes damage to the platform, its systems, the Company's rights, or the rights of third parties, the Company may pursue available legal remedies to seek compensation for damages proven to have occurred and to be causally related to the unlawful act, in accordance with the law.

This clause does not impose automatic compensation or remove a user's right to defend themselves or challenge liability or the amount of damages before the competent authorities.

Clause 17: Amendments to the Terms and Conditions

Qadaya Misr's Administration reserves the right to review and update these Terms when necessary to reflect legal, technical, or operational changes or the development of services.

The updated version will be published on the website with the revision date updated accordingly. Users will be notified of material changes where required by law.

Continued use of the services after amendments take effect is governed by applicable legal requirements, without prejudice to rights protected by mandatory law.

Clause 18: Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws in force in the Arab Republic of Egypt.

The parties will seek to resolve disputes arising from the use of the platform amicably where possible, without prejudice to the right of either party to bring proceedings before the competent judicial authorities in accordance with the legally established jurisdictional rules.

Nothing in these Terms shall be interpreted as modifying judicial jurisdiction or diminishing rights established by law.

Clause 19: General Provisions

If any provision of these Terms is found to be unenforceable or contrary to law, the remaining provisions shall remain effective to the extent permitted by law.

The Company's failure to exercise a right in a particular case shall not constitute a waiver of that right in other cases.

These Terms, together with the policies and notices applicable to the relevant services, form the framework governing use of the platform, subject to any separate agreement that may apply.
